Announcement of Public Comment Period on New Mexico Department of the Environment’s Proposed Water Reuse Regulations

The New Mexico Department of the Environment (NMED or the Division) is pleased to inform the public of NMED’s proposed water reuse regulation, “Surface and Surface Water Protection – Supplemental Requirements for Water Reuse” (20.6.8 NMAC). is seeking comment.

NMED will consider comments submitted to the Department through this public comment period to further develop the proposed rule prior to filing for a rulemaking hearing.

As mandated by the Water Quality Control Commission (WQCC), the Department has drafted the State’s Ground and Surface Water Protection – Supplemental Requirements for Water Reuse (20.6.8 NMAC), including limited reuse of treated produced water. (water derived from oil and gas activities for purposes other than or unrelated to the oil and gas industry). NMED will post subsequent updates during this process on the department’s website.

The 30-day public comment period for the proposed regulations (the “Draft Public Comments”) will begin on November 1, 2023 and end at 5:00 PM MST on December 1, 2023.

Individuals who wish to submit comments or request further information regarding the proposed regulations may do so electronically through the Department. If you respond via email, please type “Water Reuse Regulations” in the subject line and include your name and job title.
